Pro-Lifer sues Kamala Harris for violating First Amendment rights

The Center for Medical Progress (CMP) released a new video showing the abortion radicalism of anti-Life Democrat Vice Presidential candidate Kamala Harris.  CMP founder, David Daleiden, explains in the video how Harris worked with abortionists and activists at Planned Parenthood to try to silence Pro-Lifers in California.  In response, CMP is suing Harris for violating the citizen journalists’ First Amendment rights.

In 2015, CMP released undercover videos showing Planned Parenthood, America’s largest abortion business trafficking body parts taken from babies killed in abortion.  The videos included numerous conversations in restaurants and at conferences with Planned Parenthood abortionists and executives.  Harris, then attorney general of California, accused Daleiden and CMP of violating a California law that forbids secret recording of private conversation.  Harris even sent agents from the California Department of Justice to raid Daleiden’s one-bedroom apartment and confiscate the computer and recording equipment that Daleiden was using to publish the bombshell videos online.

Explaining the situation in the latest video, Daleiden said, “I’m not the first person to ever record undercover video in California.”  He gives examples of local news stations recording undercover videos to expose unethical factory farming and illegal medical practices.  Daleiden adds, “Yet somehow, I have become the first person to ever have the California video recording law enforced against me for news gathering.” 

Daleiden explains that the undercover footage recorded in California intentionally took place in public settings, such as busy restaurants, where conversations could easily be overheard.  These were not private and confidential meetings that could run the risk of being deemed illegal under the California recording law.  Other undercover investigations in California include what could be considered private conversations, such as closed-door meetings in doctors’ offices.

Why then was CMP targeted and pursed relentlessly by Harris for undercover investigations?  Daleiden observes, “It’s pretty obvious that the reason that I alone was targeted by Kamala Harris was because I dared to criticize Planned Parenthood and the abortion industry. What Kamala Harris did isn’t treating people fairly or equally under the video recording law.”

CMP has obtained documents showing that Harris’s pursuit of CMP came after a political meeting with Planned Parenthood.  At the time, Harris was running for the United States Senate and promoting Planned Parenthood.  Within weeks of the meeting, Harris had agents raid Daleiden’s apartment.  Based on these fabricated charges, Daleiden could face a prison sentence.

The most recent CMP video highlights the shocking miscarriage of justice in California.  The purpose of CMP’s recordings were to expose criminal activity, which they most certainly did.  The most compelling proof of the veracity of CMP’s investigative findings comes from one of the businesses partnered with Planned Parenthood in trafficking baby body parts.  CMP reports that DaVinci Biosciences “admitted guilt for illegally selling body parts from Planned Parenthood and were shut down in a $7.8 million settlement, and the Orange County District Attorney credited CMP’s undercover reporting with prompting the successful case.”

Daleiden clarifies, “Selling body part is a crime; reporting on it is not.”  Harris’s politically-motivated attack on free speech is profoundly un-American.  Instead of pursuing and prosecuting the real criminals, Planned Parenthood, then-Attorney General Harris revealed her commitment above all else to the continued killing of preborn babies in abortion.  Protecting her cronies at Planned Parenthood was more important that justice.

In response, Daleiden and CMP have filed a civil rights lawsuit in Los Angeles federal court.  The suit includes Harris, as well as Planned Parenthood and the acting attorney general, Xavier Becerra.  In the lawsuit, Daleiden alleges that Harris violated his First Amendment rights.  Her objection to his recording was not based on the nature of the recordings, which were in fact legal, but because she did not like what he had to say.

Closing the most recent video, Daleiden proclaims, “I will never bow to the tyrannical vision of leaders like Kamala Harris who believe that they are entitled to tell us what to think, what to believe, and what to say.”  In order to advocate for Life, we must ensure that our right to free speech is robustly protected; in order to be a voice for the most vulnerable, we must be able to speak.  Daleiden’s courageous fight against anti-Life radicals like Harris helps the work of Pro-Lifers across the country.
